MapleCap Partners AG (`"`MapleCap`"`, the `"`Firm`"`) acknowledges the importance of handling personal data processed in the course of its business activities in a lawful and appropriate manner. To this end, MapleCap has implemented a Data Protection Policy (the `"`Policy`"`) to ensure compliance with applicable data protection regulations.
The Policy applies to all employees and outsourced service providers involved in the processing of personal data. Any reference to MapleCap`'`s processing of personal data shall also be interpreted to include processing by third parties acting on behalf of MapleCap, unless expressly stated otherwise.
All personal data will be collected and processed in accordance with the principles of `"`lawfulness of processing.`"` In general, personal data relating to clients, investors, and employees of the Firm will be processed based on the Firm`'`s `"`legitimate interests.`"` However, each instance will be evaluated and determined in accordance with the applicable legal requirements for lawful processing. Where appropriate, such as for marketing purposes, freely given and specific consent will be obtained.
MapleCap engages various third-party service providers in the course of its business operations. The Firm has conducted due diligence on these providers to ensure they meet the required standards of data protection compliance. Some of these providers may be involved in the transfer and processing of personal data on behalf of the Firm, acting in the capacity of `"`data processors.`"` MapleCap also notes that certain third parties may identify themselves as `"`data controllers`"` if they assume responsibility for determining how personal data is processed.
MapleCap implements physical, electronic, and procedural safeguards in compliance with data protection legislation to protect the personal data in its possession. Access to personal data is restricted to those employees who have a legitimate need to access such information. To the extent practicable, MapleCap ensures that the personal data it holds is accurate and endeavors to keep it up to date.
Information provided to data subjects, whether in response to the exercise of their rights or to notify them of the collection and purpose of their personal data, will generally be furnished free of charge. However, MapleCap reserves the right to impose a reasonable fee if such requests are deemed excessive or manifestly unfounded.
